隐私保护政策

横河电机(中国)有限公司和母公司横河电机株式会社(以下简称“横河集团”或“我们”)认为您的隐私很重要。我们遵守数据安全及个人信息保护相关的适用法律法规、本政策及横河集团相关规章制度,采取适当的信息安全技术和管理措施,致力于妥善保护业务伙伴的个人信息。
为确保您在与我们进行业务互动的过程中获得积极的用户体验,同时对您的个人信息进行妥善保护,我们将通过《隐私保护政策》(以下简称“本政策”)帮助您了解我们收集、使用、存储和共享个人信息的情况,以及您所享有的相关权利。

 

一、我们如何收集和使用您的个人信息

在您使用我们的网站、产品及与我们互动时,我们可能收集关于您的数据,包括您的姓名、电话号码、传真号码、邮件地址、国籍、时区、使用语言、邮编、详细住址、公司名、公司网址、职务及其他《中华人民共和国个人信息保护法》中所定义的个人信息(以下简称“个人信息”)。

我们可能通过下列途径和场景收集您的上述个人信息:
• 当您利用我们的公司网页和其他社交软件与我们进行业务咨询与交流时;
• 当您利用Webex Event软件服务、Webinar网络平台、微信平台及Cisco event等平台参与我们组织的市场、直播、培训、研讨、会议等活动时;
• 当您与我们进行商业交流活动时(如行业展览、参观横河In-space展厅、业务交流会议、参加横河培训、招投标活动、商业项目洽谈等);
• 在您使用横河产品和服务过程中。

保存期限:

我们将根据法律法规的规定将您的上述个人信息为了必要、合理的目的保留五年,期间我们将保证采取一切适当的技术和措施防止您的个人信息为任何未经授权的第三方获取或使用。在期限届满后,我们将对存储的个人信息进行删除或匿名化处理,若上述个人信息与第三方共享的,我们还将要求该第三方删除或匿名化您的个人信息,但为实现必要合理目的进行保留的,或法律另有规定的除外。

我们收集您个人信息用于以下目的:
•  回应您的咨询,提供您要求的产品、服务、技术支持信息。
•  向您发送横河产品或服务的信息或通知;如果您不想接收上述信息,可以随时退订或拒绝;
•  邀请您参加横河举办的活动(例如产品和技术研讨会、培训等)及调查问卷等。如果您不想接收上述信息,可以随时退订或拒绝;
• 进行市场数据分析、市场推广服务;
• 执行双方签订的合同,处理付款、安排发货、交付和售后及维保服务;
• 改善我们的网站和其他在线服务。
• 认证和管理供应商及合作伙伴,与供应商及合作伙伴沟通或开展业务;
  
如果您选择向我们提供第三方的个人信息(例如在我们举办的线上会议邀请中追加第三方的姓名、电子邮件和电话号码),表示您事先获得了第三方的许可。
 
二、我们如何委托处理、共享、转让、公开披露您的个人信息

1、委托处理

我们向您提供产品、服务或与您进行互动时,为实现提供产品、服务的必要目的,您的个人信息可能通过我们的合作伙伴提供。 对我们委托处理个人信息的公司、组织和个人,我们会与其签署严格的保密协定,要求他们按照我们的要求、本政策以及其他任何相关的保密和安全措施来处理个人信息。
 
2、共享
我们不会与横河集团以外的任何公司、组织和个人分享您的个人信息,但以下情况除外:
(1)在获取您同意的情况下共享:获得您的明确同意后,我们会与第三方共享您的个人信息。
(2)基于软件及系统供应商(包括但不限于Webex Event软件、Webinar网络平台、微信平台及Cisco event平台等)完成基本业务功能情形下的共享:只有共享您的个人信息,才能提供您所要求的产品和服务,如: 通过特定系统向您发送网络研讨会会议信息及邀请,通过Webex Event软件服务、Webinar网络平台、微信平台及Cisco event平台等方式参与网络研讨会、培训及直播活动。
(3)与授权合作伙伴共享:仅为实现本政策中声明的目的,我们的某些服务将由我们和授权合作伙伴共同提供。我们仅会基于合法、正当、必要、特定、明确的目的共享您的个人信息,授权合作伙伴只能接触到其履行职责所需信息,且不得将此信息用于其他任何目的,除非另行获得您的明示同意。
(4)在法定情形下的共享:我们可能会根据法律法规规定、诉讼、争议解决需要,或按行政、司法机关依法提出的要求,对外共享您的个人信息。
 
3、转让
我们不会将您的个人信息转让给任何公司、组织和个人,但以下情形除外:
(1) 获得您的明确同意后,我们会向第三方转让您的个人信息;
(2) 在涉及合并、收购或破产清算时,如涉及到个人信息转让,我们会在要求新的持有您个人信息的公司、组织继续受本政策的约束,否则我们将要求该公司、组织重新向您征求授权同意。
 
4、公开披露
我们仅会在以下情形下,公开披露您的个人信息:
(1)获得您明确同意后;
(2)在法律、法律程序、诉讼或政府主管部门强制性要求的情况下,我们可能会公开披露您的个人信息。
 
三、我们如何保护您的个人信息
我们遵守有关个人信息保护、数据隐私保护和数据安全的适用法律,建立信息安全管理制度体系和组织结构,并采取业界普遍认可的信息安全管理和技术措施,妥善保管您的个人信息,防止未经授权的访问、披露、使用、篡改、损坏或丢失。为了保护您的个人信息的安全和隐私,横河集团采用内部规则约束我们的员工和管理人员。
若不幸发生个人信息泄露等信息安全事件后,我们会立即采取措施阻止安全事件扩大,并按照法律法规的要求及时告知您。难以逐一告知个人信息主体时,我们会采取合理、有效的方式发布公告。

 
四、您如何管理自己的信息
您可以通过以下方式访问及管理您的信息。
 
1、查阅、更正、补充和复制您的信息
您有权查阅、更正、补充和复制您的信息。
 
2、删除您的信息
在以下情形中,您可以向我们提出删除个人信息的请求:
(1)如果我们处理个人信息的行为违反法律法规;
(2)如果我们收集、使用您的个人信息,却未征得您的同意;
(3)如果我们处理个人信息的行为违反了与您的约定;
(4)如果您撤回同意的;
(5)如果您不再使用我们的产品或服务,或您注销了账号;
(6)如果我们不再为您提供产品或服务。
若我们决定响应您的删除请求,我们还将同时通知从我们获得您的个人信息的实体,要求其及时删除,除非法律法规另有规定,或这些实体获得您的独立授权。
当您从我们的服务中删除信息后,我们可能不会立即在备份系统中删除相应的信息,但会在备份更新时删除这些信息。
 
3、改变您授权同意的范围
如果您不想接受我们给您发送的邮件提醒(如网络研讨会的邀请邮件),您随时可以按照邮件中提供的停止订阅的方式要求我们停止向您发送此类邮件。
 
4、响应您的上述请求
为确保安全,您可能需要提供书面请求,或以其他方式证明您的身份。我们可能会先要求您验证自己的身份,然后再处理您的请求。
我们将在三十个工作日内作出答复。如您不满意,还可以通过以下途径投诉:

对于您合理的请求,我们原则上不收取费用,但对多次重复、超出合理限度的请求,我们将视情收取一定成本费用。对于那些无端重复、需要过多技术手段(例如,需要开发新系统或从根本上改变现行惯例)、给他人合法权益带来风险或者非常不切实际(例如,涉及备份磁带上存放的信息)的请求,我们可能会予以拒绝。
在以下情形中,我们将无法响应您的请求:
(1)与我们履行法律法规规定的义务相关的;
(2)与国家安全、国防安全直接相关的;
(3)与公共安全、公共卫生、重大公共利益直接相关的;
(4)与刑事侦查、起诉、审判和执行判决等直接相关的;
(5)有充分证据表明您存在主观恶意或滥用权利的;
(6)出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的;
(7)响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的;
(8)涉及商业秘密的。
 
五、 您的个人信息如何在全球范围转移
原则上,我们在中华人民共和国境内收集和产生的个人信息,将存储在中华人民共和国境内。作为一家跨国企业,横河集团通过遍布全球的服务网点、资源和服务器为世界各地的客户提供产品或服务。基于我们的客户信息管理战略,我们可能通过横河全球统一的客户信息管理系统和业务处理系统与集团总部横河电机株式会社共享您的个人信息,以整合横河集团的全球资源为您提供更优质更及时的服务。同时, Webex Event软件及系统供应商亦有可能同时备份您的信息。这意味着,在获得您的授权同意后,您的个人信息可能会被转移到您使用产品或服务所在国家/地区的境外管辖区,或者受到来自这些管辖区的访问。但我们仅在限于实现业务处理等目的所需的尽可能小的范围内与境外接收方共享您的个人信息,并在传输过程中采取适当的技术保护措施。

我们已经遵照中国法律(包括《中华人民共和国个人信息保护法》)要求就您的个人信息出境与境外接收方签订标准合同并进行影响评估,以识别和控制个人信息出境的可能风险及明确境内外双方在传输和保护您个人信息中的权利和义务。

 
六、 我们如何处理儿童的个人信息
在数字化办公、业务沟通与协同活动中我们推定您具有相应的民事行为能力。如您为儿童,我们要求您请您的父母或其他监护人仔细阅读本政策,并在征得您的父母或其他监护人同意的前提下使用我们的服务或向我们提供信息。
对于经父母或监护人同意而收集儿童个人信息的情况,我们只会在受到法律允许、父母或监护人明确同意或者保护儿童所必要的情况下使用或公开披露此信息。
尽管当地法律和习俗对儿童的定义不同,但我们将不满 14 周岁的任何人均视为儿童。
如果我们发现自己在未事先获得可证实的父母或监护人同意的情况下收集了儿童的个人信息,则会设法尽快删除相关数据。

我们的隐私保护政策可能变更。
我们会在本页面上发布对本政策所做的任何变更。
如该等变更会导致您在本政策项下权利的实质减损,我们还会提供更为显著的通知(包括对于某些服务,我们会通过电子邮件发送通知,说明隐私保护政策的具体变更内容)。

Privacy Protection Policy

Yokogawa China Co., Ltd. and its parent company Yokogawa Electric Corporation (hereinafter referred to as "Yokogawa group" or "we") think your privacy is important. We comply with applicable laws and regulations related to data security and personal information protection, this policy, and relevant rules and regulations of Yokogawa group, adopt appropriate information security technology and management measures, and are committed to protecting the personal information of our business partners properly.
To ensure that you can get a positive user experience during your interaction with us and simultaneously protect your personal information properly, we will help you understand our collection, use, storage and sharing of personal information through the privacy protection policy (hereinafter referred to as "this policy"), as well as the relevant rights you enjoy.
 

I. How we collect and use your personal information

When you use our website, products and interact with us, we may collect data about you, including your name, telephone number, fax number, email address, nationality, time zone, language used, postcode, detailed address, company name, company website, position and other personal information defined in the Personal Information Protection Law of the People's Republic of China (hereinafter referred to as "personal information"). 

We may collect your aforementioned personal information through the following channels and scenarios:
* When you conduct business consulting and communication with us through our company website and other social media;
* When you participate in our marketing, live streaming, training, seminars, conferences, and other activities with Webex Event software services, Webinar network platforms, WeChat platforms and Cisco event platforms;
*  When you engage in business exchange activities with us (such as industrial exhibitions, visit to Yokogawa’s In-space exhibition hall, participation in business exchange meetings, Yokogawa’s training, bidding activities, commercial project negotiations, etc.);
* During your use of Yokogawa’s products and services


Storage life:
We will keep your personal information for necessary and reasonable purposes for five years in accordance with laws and regulations. During this period, we will ensure that we take all appropriate technologies and measures to prevent your personal information from being obtained or used by any unauthorized third party. Upon expiration of the term, we will delete or anonymize the stored personal Information. If such personal Information is shared with a third party, we will also require such third party to delete or anonymize your personal Information, unless it is retained for necessary and reasonable purposes or otherwise provided by law.

We collect your personal information for the following purposes:
* To respond to your inquiry, and provide the product, service and technical support information you request;
* To send you information or notifications about Yokogawa’s products or services; If you do not want to receive the above information, you can unsubscribe or refuse at any time;
* To invite you to participate in activities organized by Yokogawa, such as product and technology seminars and training, and survey questionnaires. If you do not want to receive the above information, you can unsubscribe or refuse at any time;
* To perform market data analysis and market promotion services;
* To execute the contract signed by both parties, handle payment, arrange shipment, delivery, and after-sales and maintenance services;
* To improve our website and other online services;
* To authenticate and manage suppliers and partners, communicate or conduct business with them

If you choose to provide us with third-party personal information (such as adding the third party's name, email and phone number to our online conference invitation), you have obtained the third party's permission in advance.


II. How we commission, share, transfer and publicly disclose your personal information
 
1.    Entrusted processing
When we provide products, services or interact with you, your personal information  may be provided through our partners in order to achieve the necessary purpose of providing our products and services. We will sign strict confidentiality agreements with companies, organizations and individuals entrusted by us to handle personal information, requiring them to process personal information in accordance with our requirements, this policy and any other relevant confidentiality and security measures.
 
2.    Sharing
We will not share your personal information with any company, organization or individual other than Yokogawa group, except for the following situations:
(1) Share with your consent: With your explicit consent, we will share your personal information with third parties.
(2) Sharing based on software and system suppliers (including but not limited to Webex Event software, Webinar platform, Wechat platform and Cisco Event platform, etc.) completing basic business functions: Only by sharing your personal information we can provide the products and services you require, such as sending webinar conference information and invitation to you through a specific system, participating in online seminars, trainings, and live events via Webex Event software service, Webinar platform, Wechat platform, and Cisco Event platform, etc.
(3) Share with authorized partners: Only for the purposes stated in this policy, some of our services will be provided by us and authorized partners. We will only share your personal information for legitimate, proper, necessary, specific and explicit purposes. Authorized partners can only access the information they need to perform their duties and shall not use this information for any other purpose, unless otherwise expressly agreed by you.
(4) Sharing under legal circumstances: We may share your personal information with the public in accordance with laws and regulations, litigation, dispute resolution needs, or according to the requirements of administrative and judicial organs.
 
3.    Assignment
We will not assign your personal information to any company, organization or individual except:
(1) With your explicit consent, we will assign your personal information to a third party;
(2) In the case of merger, acquisition or bankruptcy liquidation, if the assignment of personal information is involved, we will require the new company or organization holding your personal information to continue to be bound by this policy; otherwise, we will require the company or organization to seek your authorization and consent again.
 
4.    Public disclosure
We will only disclose your personal information in the following circumstances:
(1) With your explicit consent;
(2) We may disclose your personal information under the circumstances of law, legal proceedings, litigation or mandatory requirements of government authorities.
 

III. How we protect your personal information

We comply with applicable laws regarding personal information protection, data privacy protection, and data security, establish an information security management system and organizational structure, and adopt widely recognized information security management and technical measures in the industry to properly safeguard your personal information and prevent unauthorized access, disclosure, use, tampering, damage, or loss. In order to protect the security of your personal information and privacy, Yokogawa group uses internal rules to restrict our employees and managers.

In case of personal information leakage and other information security incidents, we will immediately take measures to prevent the expansion of security incidents and inform you in time according to the requirements of laws and regulations. When it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to release the announcement.


IV. How you can manage your information
You can access and manage your information in the following ways.
 
1.    Consult, correct, supplement and duplicate your information
You have the right to consult, correct, supplement and duplicate your information.
 
2.    Delete your information
You can request us to delete personal information in the following situations:
(1) If we deal with personal information in violation of laws and regulations;
(2) If we collect and use your personal information without your consent;
(3) If our handling of personal information violates the agreement with you;
(4) If you withdraw your consent;
(5) If you no longer use our products or services, or you cancel your account;
(6) If we no longer offer you products or services.


If we decide to respond to your request for deletion, we will also notify the entities that have obtained your personal information from us and ask them to delete them in a timely manner, unless otherwise stipulated by laws and regulations, or if these entities are authorized by you independently.
When you delete information from our services, we may not delete the corresponding information in the backup system immediately, but will delete the information when the backup is updated.
 
3. Change the scope of your authorization
If you don’t want to accept email reminders (e.g. webinar invitation emails) we send you, you can ask us to stop sending you such emails at any time according to the way of stopping subscription provided in the email.
 
4. Respond to your request
For security, you may need to provide a written request or other means to prove your identity. We may ask you to verify your identity before processing your request.
We will reply within 30 days. If you are not satisfied, you can also complain through the following channels:

In principle, we will not charge you for your reasonable request, but we will charge a certain cost for repeated requests beyond the reasonable limit. We may reject requests that are unreasonably repetitive, require excessive technical means (e.g., the need to develop new systems or radically change existing practices), pose a risk to the legitimate rights and interests of others, or are highly impractical (e.g., involving information stored on backup tapes).
We will not be able to respond to your request in the following situations:
(1) Related to the performance of our obligations under laws and regulations;
(2) Directly related to national security and national defense security;
(3) Directly related to public safety, public health and major public interests;
(4) Directly related to criminal investigation, prosecution, trial and execution of judgments;
(5) There is sufficient evidence to show that you have subjective malice or abuse of rights;
(6) In order to protect your or other personal life, property and other major legitimate rights and interests, but it is difficult to obtain your consent;
(7) Responding to your request will cause serious damage to the legitimate rights and interests of you or other individuals and organizations;
(8) Involving trade secrets.
 

V. How your personal information is transferred globally
In principle, the personal information we collect and generate within the People's Republic of China will be stored in the People's Republic of China. As a multinational company, Yokogawa group provides products or services for customers around the world through its globally distributed service outlets, resources, and servers. Based on our global strategy of customer information management, we may share your personal information with Yokogawa Electric Corporation, the group headquarters, through Yokogawa’s globally unified customer information management system and business processing system, in order to integrate Yokogawa group’s global resources and provide you with better and more timely services. In the meantime, Webex Event software and system suppliers may also back up your information. This means that after obtaining your authorized consent, your personal information may be transferred to or accessed from overseas jurisdictions in the countries / regions where you use the products or services. But we only share your personal information with overseas recipients within the minimum scope required for business processing and other purposes, and take appropriate technical protection measures during the transmission process.
We have followed the requirements of Chinese laws (including the Personal Information Protection Law of the People's Republic of China) to sign a standard contract and conduct an impact assessment with overseas recipients regarding the export of your personal information, in order to identify and control the potential risks of personal information export and clarify the rights and obligations of both domestic and foreign parties in the transmission and protection of your personal information.

 
 
VI. How we process children's personal information
In digital office, business communication and collaborative activities, we presume that you have the corresponding civil capacity. If you are a child, we ask your parents or other guardians to read this policy carefully and use our services or provide information to us with the consent of your parents or other guardians.
In the case of collecting children's personal information with the consent of parents or guardians, we will only use or disclose such information to the extent permitted by law, with the explicit consent of parents or guardians, or necessary for the protection of children.
Although local laws and customs have different definitions of children, we regard anyone under 14 as a child.
If we find that we have collected personal information about a child without the prior consent of a verifiable parent or guardian, we will try to delete the data as soon as possible.
 

VII. How we update this policy
Our privacy protection policy may change.
We will post any changes to this policy on this page.
If such changes will result in substantial impairment of your rights under this policy, we will also provide more significant notices (including for some services, we will send notices via e-mail stating the specific changes of privacy protection policy).
In each case, if you continue to use our services, you agree to be bound by the revised policy.
